Would this hold a 40 inch tire?
No. It hold a 37" spare tire maximum. Thanks for your inquiry.
does this fit a 2016 jeep wrangler unlimited jk?
No, this will not fit the earlier JK Wranglers
So I just got oof the phone with a customer serive representative and they told me that I can just buy this mounting kit and it will work for now for my 35 inch tire and if I decided down the line that I needed the hinge kit could do that later?
It is not recommended. The hinges and latch are not designed to carry the weight of oversized tires and wheels. You risk damage to the Jeep not using the hinge reinforcement kit.
